UK SC Decision Creates Immediate Legal Gaps for Trans People
Yesterday, the UK Supreme Court ruled that the legal definition of "woman" under the Equality Act excludes trans women. This decision comes as part of a case brought forward by campaigners seeking to roll back protections for trans women and intersex people. While the court emphasised that this decision should not be seen ‘as a triumph for one group at the expense of another’, it is clear that this ruling has immediately created significant legal gaps, as well as understandable concern and distress for the trans community in the UK and Gibraltar.
Together Gibraltar stands firmly with our local trans and non-binary community and wishes to confirm their commitment to a legal system in Gibraltar which provides adequate protections for the most vulnerable. This ruling highlights the inadequacies of the UK Equality Act in protecting trans people, and is a stark reminder of the importance of ensuring Gibraltar's laws remain robust, inclusive and able to stand alone. We must never allow such gaps in protection to take root here.
It is deeply regrettable that the UK has allowed hateful individuals to weaponise the existence of trans people to sow division, going so far as to align themselves with fascists like Donald Trump.
Equally troubling is the disproportionate platform given by the media to these fringe views, despite the overwhelming majority of British people believing that transgender individuals deserve to live in peace, free from discrimination.
